1. Eligibility 1.1 The Festival is open to individuals and entities who meet the eligibility criteria specified by the Organiser. 1.2 Participants must be of legal age according to the laws of their country of residence or have obtained parental/guardian consent to participate.
2. Registration 2.1 Participants must complete the registration process as outlined by the Organiser. 2.2 Registration may involve providing personal information, including but not limited to, name, contact details, and relevant credentials. 2.3 All registration information must be accurate, complete, and up-to-date. False or misleading information may result in disqualification.
3. Submission 3.1 Participants may be required to submit creative works, proposals, or other materials as part of the Festival. 3.2 Submission guidelines, deadlines, and specifications will be communicated by the Organiser and must be adhered to. 3.3 Participants retain ownership of their submitted works but grant the Organiser the right to use, display, and distribute submitted materials for Festival-related purposes.
4. Intellectual Property 4.1 Participants warrant that they have the necessary rights, licenses, and permissions for any materials submitted as part of the Festival. 4.2 Participants agree not to submit any materials that infringe upon the intellectual property rights of others. 4.3 The Organiser reserves the right to disqualify any participant found to be in violation of intellectual property rights or engaging in plagiarism.
5. Judging 5.1 The Festival may involve a judging process to evaluate submissions and determine winners. 5.2 Judges will be appointed by the Organiser and their decisions will be final and binding. 6.3 Participants agree to accept the outcome of the judging process without recourse to legal action.
6. Prizes 6.1 Prizes may be awarded to winners of the Festival as determined by the Organiser. 6.2 Prize details, eligibility criteria, and distribution methods will be communicated by the Organiser.6.3 Prizes are non-transferable and may not be exchanged for cash or alternative rewards unless specified by the Organiser.
7. Code of Conduct 7.1 Participants are expected to conduct themselves in a respectful and professional manner throughout the Festival. 7.2 Harassment, discrimination, or any other form of inappropriate behaviour will not be tolerated and may result in disqualification. 7.3 Participants must adhere to any additional rules or guidelines provided by the Organiser during the Festival.
8. Modification and Termination 8.1 The Organiser reserves the right to modify, suspend, or terminate the Festival at any time for any reason, without liability. 8.2 In the event of modification, suspension, or termination, the Organiser may provide notice to participants via email or other communication channels.
9. Limitation of Liability 9.1 To the fullest extent permitted by law, the Organiser shall not be liable for any direct, indirect, incidental, special, or consequential damages arising out of or in any way connected with the Festival. 9.2 Participants participate in the Festival at their own risk and agree to indemnify and hold harmless the Organiser from any claims, losses, or damages incurred.
10. Governing Law 10.1 These Terms and Conditions shall be governed by and construed in accordance with the laws of Augusta Margaret River Shire. 10.2 Any disputes arising out of or in connection with these Terms and Conditions shall be subject to the exclusive jurisdiction of the courts of the Augusta Margaret River Shire.
